Terms of Service

1. Introduction

Welcome to Daemon ("we," "our," or "us"). By accessing or using our platform, website, API, and services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Use of Services

2.1 Eligibility

You must be at least 18 years old to use the Service. 3. AI Agents and Outputs

3.1 AI Services

The Service allows you to deploy and manage autonomous AI agents ("Agents"). You acknowledge that Agents may generate output ("Output") that is probabilistic and may not always be accurate. You are responsible for evaluating and validating all Output before using it.

3.2 Content Ownership

As between you and Daemon, you own all rights, title, and interest in and to the data and content you input into the Service ("Input") and the Output generated by your Agents, subject to your compliance with these Terms. You grant Daemon a worldwide, non-exclusive, royalty-free license to use, host, store, and display your Input and Output solely as necessary to provide and improve the Service.

4. Intellectual Property

The Service, including its "look and feel" (e.g., text, graphics, images, logos, and button icons), proprietary content, information and other materials, and all content and other materials contained therein, including, without limitation, the Daemon logo and all designs, text, graphics, pictures, data, software, sound files, other files, and the selection and arrangement thereof are the proprietary property of Daemon or our licensors and are protected by copyright, patent and trademark laws.

5. Fees and Payment

We may charge fees for the use of certain features of the Service. You agree to pay all fees in accordance with the pricing and payment terms presented to you for such Service. All fees are non-refundable unless otherwise required by law.

6. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. DAEMON DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

8. Limitation of Liability

IN NO EVENT SHALL DAEMON BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE.
